We work closely with you at every stage of a Chapter 7 or Chapter 13 bankruptcy. Under Chapter 7, you can discharge certain debts in exchange for the sale or liquidation of assets. Some debts, such as child support, student loans and some tax obligations, cannot be discharged. In addition, certain assets, such as a principal residence and a vehicle, will be exempt from sale. We will make sure that you know what you can discharge before you decide to file and will ensure that all exempt assets are safe from liquidation.

The New Bankruptcy Law

The bankruptcy laws changed in 2005. Though you can still do many of the same things you could do under the prior law, there have been some significant changes. It is now more difficult for you to get the benefits of a Chapter 7. You must now submit to a means test to qualify to file under Chapter 7. If you cannot file under Chapter 7, your only other bankruptcy option will be under Chapter 13. In a Chapter 13 bankruptcy, you must enter into an agreement to repay your creditors over a period of three to five years.
